We reserve the right, from time to time, with or without notice to you, to change these Terms in our sole and absolute discretion. The most current version of these Terms can be reviewed at this site. The most current version of these Terms will supersede all previous versions.

In order to become a Member of MoonBack, you must register to create an account. You may be either an individual Member.
During the registration process, you will be required to provide certain information, and you will create a MoonBack username and a password. You agree to provide accurate, current and complete information during the registration process and to update such information regularly to keep it accurate, current and complete. We reserve the right to suspend or terminate your subscription and Membership in the Service if any information provided during the registration process or thereafter proves to be inaccurate, not current or incomplete.

- Subscription Types and Fees; Inactive Subscription
As a Member, you can choose to be enrolled in either a trial or paid subscription. A trial subscription is available on a limited time or limited storage capacity basis and at no charge. A paid subscription is available on a monthly or annual basis; the subscription fee may vary depending on storage capacity and other features.
If you exceed the limits of your current subscription, you may be prevented from adding more Content, and you will be prompted to upgrade your subscription. You may upgrade your subscription at any time by accessing the "Settings" section of the Site and Applications.
If you downgrade your subscription, you may be unable to upload content in excess of the limits of your downgraded subscription. In the event that you continue to have content in excess of the limits for your subscription level, you will be prompted to either upgrade your subscription or delete files to free up storage. If you do not delete sufficient files, we reserve the right to suspend or terminate your subscription.
If your trial subscription remains inactive for ninety (9) days or more, then we, in our sole discretion, may suspend or terminate your subscription and delete any or all of your stored Content; we will try to provide you with notice prior to deleting your Content or deactivating your subscription but are under no obligation to do so.

By enrolling into a paid subscription, you expressly allow us to charge a subscription fee to the payment method (“Payment Method”) you selected during purchase (or to a different Payment Method if you change your billing information) at the then-current rate, and any other charges or taxes that may apply in connection with your use of the Service. As used in these Terms, "billing" will indicate either a charge or debit, as applicable, against your Payment Method. An applicable subscription fee will be billed at the beginning of the paying portion of your paid subscription and each month thereafter (if you chose a monthly subscription), or annually (if you chose an annual subscription), unless and until you cancel your subscription. You agree that it is your responsibility to keep your Payment Method up-to-date; we expressly reserve the right to suspend or terminate your Membership and subscription in the event we are unable to charge to your Payment Method. - Automatic Renewal and Notice
We will automatically bill to the Payment Method and renew your paid subscription for another term when each term expires. We will inform you by email before automatically renewing your annual subscription to the Service. We will not notify you on a monthly basis if you are enrolled into a monthly subscription. Each month-to-month subscription will renew for an additional month at the end of each month, and each annual subscription will renew for an additional year at the end of the current year. Unless otherwise specified, the automatically renewed subscription will be for the same term and at the same price as the prior subscription. We will notify you in advance of any change in the amount to be charged for the renewed subscription in the pre-renewal notification. Each automatic renewal and corresponding payment will be processed on the first day of the new term.
- Automatic Enrollment Following Free Trial or Promotion
From time to time, we may offer you promotions that provide a discount on paid subscriptions or make paid subscriptions free for a period of time. Depending on the terms of your promotional offer, you may be enrolled into a paid subscription following the expiration of your promotional period unless you cancel prior to the end of the promotional period.

You may cancel your subscription to the Service at any time. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY SUBSCRIPTIONS. To cancel, you will need to contact Customer Support at .

5. Right to Terminate
We reserve the right to terminate, suspend or restrict your Membership and subscription to the Service, with or without notice, for any or no reason whatsoever. If we do so, we will try to let you know in advance and help you retrieve your original uploaded videos, although there may be some cases (for example, repeated or flagrant violation of these Terms, a court order, or danger to other users) where we may suspend immediately.
6. Effect of Cancellation, Expiration or Termination
In the event of cancellation, expiration, downgrade or termination of your subscription or Membership, you may be unable to access your Content and you may no longer be allowed to upload additional Content. You may also lose access to certain features or functionality only available to current subscribers.
IN THE EVENT OF CANCELLATION, EXPIRATION, DOWNGRADE, OR TERMINATION OF YOUR SUBSCRIPTION OR MEMBERSHIP, WE MAY ALSO DELETE SOME OR ALL OF YOUR CONTENT. IT IS YOUR RESPONSIBILITY TO BACK-UP YOUR VIDEOS AND OTHER UPLOADED CONTENT PRIOR TO THE CANCELATION, EXPIRATION, DOWNGRADE OR TERMINATION.
7. Account Security
You are responsible for safeguarding the password you use to access the Service and you agree not to disclose your password to any third party. You are responsible for any activity using your account, whether or not you authorized the activity. You should immediately notify us of any unauthorized use of your account. You acknowledge that if you wish to protect your transmission of videos or other content to your account, it is your responsibility to use a secure encrypted connection to communicate with the Service.
8. Social Media and Networking Sites
As a Member of the Service, you have the option of granting us access to your account(s) with certain third-party social media and networking sites, such as LinkedIn or others (each, an "SNS"). Provided an SNS permits this, we can capture and make available on the Site and through the Application the photos and other content that you have stored in your account(s) with such SNSs (“SNS Content”). By granting us access to your SNS Content, you understand that we will access, make available and store (if applicable) your SNS Content so that it is available on the Site and through the Application. We are not responsible for any SNS Content stored on an SNS that you choose to make available on the Site and through the Application. Depending on the SNS you choose and subject to the privacy settings you have set in your SNS account(s), personally identifiable information that you post to your SNS account(s) will be available on the Site and through the Application. Please note that if an SNS account becomes unavailable or SNS terminates our access to your SNS account(s), any Content from that SNS will no longer be available on the Site and through the Application. You have the ability to disable the connection between the Site and Application and your SNS account(s), at any time, by accessing the "Settings" section of the Site and Application. PLEASE NOTE THAT YOUR RELATIONSHIP WITH EACH SNS, INCLUDING YOUR RIGHTS WITH RESPECT TO ANY CONTENT THAT YOU PROVIDE TO AN SNS AND THE STORAGE OF SUCH CONTENT, IS GOVERNED SOLELY BY YOUR AGREEMENT(S) WITH SUCH SNS.

Any Content you post, upload, publish, submit or transmit via the Service is subject to following terms.You must not, and must not attempt to do the following:

- breach or otherwise circumvent any security or authentication measures;
- access, tamper with, or use non-public areas or parts of the Services, or shared areas of the Services you haven't been invited to;
- interfere with or disrupt any user, host, or network, for example by sending a virus, overloading, flooding, spamming, or mail-bombing any part of the Services;
- access or search the Services by any means other than our publicly supported interfaces (for example, "scraping");
- send unsolicited communications, promotions or advertisements, or spam;
- send altered, deceptive or false source-identifying information, including "spoofing" or "phishing";
- promote or advertise products or services other than your own without appropriate authorization;
- abuse system referrals or promotions to get more storage space than deserved;
- abuse the Services in a manner that circumvents their storage space limits;
- sell the Services or Services accounts via unauthorized channels;
- use automated or other means to create accounts in bulk or to access the Services other than by using our official interface and/or APIs;
- publish or share materials that are unlawfully pornographic or indecent, or that advocate bigotry, religious, racial or ethnic hatred;
- violate the law in any way including storing, publishing or sharing material that's fraudulent, defamatory, misleading, or that violates the privacy or infringes the rights of others.
